Advertising Policies

The following Advertising Policy applies from 01 Jan 2022.

1. General Information

1.1. Advertisers must be honest about the products or services their ads promote; they must avoid content that misleads or offends; and they must never compromise our users’ privacy. These Advertising Policies apply to all ads served by myScoop.

1.2. Advertisers must comply with myScoop’s Terms of Use, Privacy Policy and Community Guidelines, and all other myScoop policies governing the use of our Services. We may update our terms, policies, and guidelines from time to time, so please check in and review them regularly.

1.3. Our user base includes 17+ years old, nonagenarians, and everyone in between. Advertisers are responsible for ensuring that their ads are suitable for Scoopers ages in each geographic area where the ads will run. They’re also responsible for ensuring that their ads comply with all applicable laws, industry codes, rules, and regulations in each geographic area where the ads will run.

1.4. We may share information related to ads with third parties, including: (i) our media partners when your ads run in context related to that media partner; and (ii) third parties whose products or services you’ve elected to use in connection with the ads.

1.5. Our users may share ads with other Scoopers or save ads to their devices. They may use any of the tools and features we make available in myScoop to apply captions, drawings, filters, or other creative elements to the ad. Age-targeted ads can be shared within mySoop with Scoopers of any age.

1.6. Ads must not falsely imply or suggest any partnership or endorsement by myScoop.

1.7. All uses of myScoop’s trademarks must comply with myScoop’s Terms of Use and Advertising Policy.

1.8. Ads may not collect information about racial or ethnic origin, political opinion, religious or philosophical beliefs, trade-union membership, health, or sex life without our prior permission.

1.9. The advertiser’s privacy policy must be made available when any personal information is collected.

1.10. Personal information must be collected and processed securely.

1.11. Ads must not state or imply knowledge of personal data, sensitive information, online activity, or the precise whereabouts of a user.

2. Review

2.1. All ads are subject to our review and approval. We reserve the right to reject or remove any ad in our sole discretion for any reason, including if the ad does not comply with these Advertising Policies. We also reserve the right to request modifications to any ad, and to require factual substantiation for any claim made in an ad.

2.2. myScoop may suspend or terminate your account(s) if you violate our Advertising Policies.

2.2.1. Upon termination, all licenses and other rights granted to you in these Advertising Policies will immediately cease.

2.3. We reserve the right to refuse access to the Service to anyone for any reason at any time.

2.4. We reserve the right to force forfeiture of any User account or ad for any reason.

3. Disclosures

3.1. All required disclosures and mandatory warnings in ads must be clear and conspicuous.

3.2. Advertiser(s) must be accurately and clearly identified in the ad.

3.2.1. The advertiser’s name and logo must be clearly visible.

4. Third-Party Services

4.1. As we mentioned in our Terms of Use, if you use a service, feature, or functionality that is operated by a third party and made available through our Services (including Services we jointly offer with the third party), each party’s terms will govern the respective party’s relationship with you. myScoop and its affiliates are not responsible or liable for a third party’s terms or actions.

5. Prohibited Ads Content

5.1. Ads that encourages dangerous or illegal activity.

5.2. Ads that encourage or glamorize:

  • (i) Drug use
  • (ii) excessive drinking
  • (iii) excessive violence, including, but no limited to harming of animals
  • (iv) exploiting an individual who is drunk or otherwise intoxicated
  • (v) scooping and driving, or other dangerous behavior, and
  • (vi) violating laws or regulations.

5.3. Ads that direct users to phishing links, malware, or similarly harmful codes or sites.

5.4. Firearms must not be pointed at the user or audience in a Lens or Filter.

5.5. Ads that infringes upon intellectual property or other third-party’s rights.

5.5.1. Ads must not infringe the intellectual property, privacy, publicity, or other legal rights of any person or entity.

5.5.2. Advertisers must obtain all necessary rights and permissions for ads they submit to be served by myScoop. Rightsholders and their agents can report alleged intellectual property infringement to myScoop. We take all complaints regarding intellectual property infringement seriously and will investigate them. Takedowns are processed in our sole discretion. We make no guarantees as to the outcome of our investigations or the legitimacy of the complaints we receive.

5.5.3. If we receive a complaint regarding intellectual property related to an ad served by myScoop, we will encourage the alleged rightsholder and advertiser to communicate directly, and we will not act as a mediator of disputes.

5.6. Ads must not feature the names, likenesses, voices (including look-alikes and sound-alikes) or other identifying features of an individual (such as transforming the user into a celebrity or a politician) without consents from all parties included in the ad.

5.7. Content that is deceptive.

5.7.1. Ads that are deceptive, false, or misleading, including deceptive claims, offers, or business practices.

5.7.2. Ads that deceive users into providing personal information without their knowledge, under false pretenses, or that otherwise misuse personal information.

5.7.3. Bait-and-switch techniques or other deceiving calls to action.

5.8. Content that is discriminatory or hateful

5.8.1. Ads that demean, degrade, discriminate, or show hate toward a particular race, ethnicity, culture, country, belief, national origin, age, sexual orientation, gender, disability, condition, or toward any member of a protected class.

5.8.2. Ads that promote bullying, including cyberbullying.

5.9. Ads that is inappropriate.

5.9.1. Ads that depict nudity (but content about breastfeeding may be permitted), sexual content, obscene gestures.

5.9.2. Ads that are shocking, sensational, or disrespectful.

5.9.3. Ads that may be considered culturally inappropriate in the selected location.

5.9.4. Ads that encourage dishonest behavior.

5.9.5. Profanity (with the exception of censored profanity).

5.10. Ads that targets children.

5.10.1. Ads that address or are intended to appeal specifically to children under the age of 17.

5.11. Ads for certain types of products or services

5.11.1. Adult products and services, including strip clubs, escort services, and specialty shops for adult products.

5.11.2. Cigarettes (including e-cigarettes), cigars, smokeless tobacco, and other tobacco products.

5.12. Products or services that infringe upon intellectual property rights of other rights, include, but not limited to those designed to bypass copyright protection (such as software or cable signal descramblers).

5.12.1. Products or services principally dedicated to selling counterfeit goods or engaging in copyright piracy.

5.13. Illegal or recreational drugs or drug paraphernalia.

5.14. Counterfeit, fake, or bootleg products, or replicas or imitations of designer products.

5.15. Firearms, weapons, or ammunitions.

5.16. Illegal wildlife trade, and products and services derived from endangered or threatened species.

5.17. App installs from sources other than the official app store for the user’s device.

5.18. Ads that solicit the user’s participation in lawsuits, or ads that ask users to report on their medical history for purposes of potential compensation.

5.19. Ads targeted to countries subject to U.K. trade sanctions and other U.K. export control laws.

5.20. Any illegal conduct, product, or enterprise.

6. Restricted Content

6.1. Alcohol. myScoop does not permit targeting ads that promote or reference alcohol to all countries.

6.2. Financial Products & Services.

6.2.1. Ads for financial products and services must clearly and prominently disclose all applicable material terms and conditions to consumers prior to the submission of an application.

6.2.2. Ads for loans must disclose, among other things, APR, repayment period, fees and costs, penalties, and the contact information of the lending institution.

6.2.3. Ads for products intended for a limited audience should only be targeted to that audience. For example, if a credit card offer is limited to individuals over the age of 21+ years, the offer’s ad campaign must be age targeted to 21+ years.

6.2.4. Ads for the following are not permitted:

6.2.4.1. Get-rich-quick or pyramid schemes or offers or any other deceptive or fraudulent offers.

6.2.4.2. Ads that promote particular securities or that provide or allege to provide insider tips.

6.2.4.3. Payday loans or predatory lending.

6.2.4.4. Initial Coin Offerings (ICOs).

2.4.5. Any other Financial Products and Services of questionable legality or other sensitivities, at myScoop’s sole discretion.

6.3. Food Products.

6.3.1. Ads for food products must accurately describe the qualities and characteristics of a food product, including any associated health and nutritional claims.

6.4. Gambling & Lotteries. myScoop does not permit targeting ads for gambling and lotteries to all countries:

6.5. Online Dating Services. myScoop does not permit targeting ads for online dating services to all countries.

6.6. Pharmaceutical & Healthcare.

6.6.1. Ads for pharmaceutical and healthcare products and services must only promote those products or services that have been approved by the local regulatory authorities in each of the countries targeted. For example, a prescription drug approved for Canada must not be advertised in the U.S., unless it has been approved for the United States as well.

6.6.2. Prescription Medicines.

6.6.2.1. myScoop permits targeting ads for prescription medications only to the following countries:

Bahrain, Canada, Costa Rica, Egypt, Hong Kong, Japan, Kuwait, New Zealand, Oman, Qatar, Saudi Arabia, Singapore, United Arab Emirates, and the United States.

6.6.2.2. Ads for online pharmacies must be registered with the relevant authorities in the country in which you are advertising. For example, in the United States and Canada online pharmacies must be verified by the National Association of Board of Pharmacies (NABP).

6.6.3. Over the Counter (OTC) Medicines.

6.6.3.1. myScoop does not permit targeting ads for OTC medicines to the following countries:

Colombia, Lebanon, Romania, and Turkey.

6.6.4. Health and Dietary Supplements.

6.6.4.1. Ads for health and dietary supplements must not:

6.6.4.1.1. Promote products that may present risks for consumers (such as those included in advisories by local regulatory agencies).

6.6.4.1.2. Promote weight-loss supplements.

6.6.4.1.3. Contain exaggerated or unrealistic claims.

6.6.4.1.4. Include “before-and-after” pictures.

6.6.4.2. Age targeting is required in the following countries:

Colombia, Greece, Kuwait, and the United States: 18+.

6.6.5. Condoms.

6.6.5.1. myScoop does not permit targeting ads for condoms to the following countries:

Bahrain, Republic of Ireland, Kuwait, Lebanon, Oman, Poland, and Qatar.

6.6.5.2. Where ads for condoms are permitted, content may not be provocative or overtly sexual in nature.

6.6.6. Hormonal Contraceptives.

6.6.6.1. myScoop does not permit targeting ads for hormonal contraceptives to the following countries:

Bahrain, Colombia, Denmark, Germany, Republic of Ireland, Italy, Kuwait, Lebanon, Oman, Poland, Qatar, Romania, Saudi Arabia, Spain, Thailand, Turkey, and the United Arab Emirates.

6.6.6.2. Hormonal contraceptives classified as medicines are subject to the policies for either prescriptions or OTC, as applicable according to country-specific requirements.

6.6.7. PlasticSurgery.

6.6.7.1. myScoop does not permit targeting ads for plastic surgery to the following countries:

Greece, India, Indonesia, Italy, Jordan, Lebanon, Oman, Philippines, Poland, and Turkey.

6.6.7.2. Ads for plastic surgery must be age targeted to 18+ years.

6.6.8. Prenatal Gender Determination.

6.6.8.1. Ads for tests to determine prenatal gender are not permitted in India.

6.6.9. Political Advertising

6.6.9.1. Political ads are subject to myScoop’s sole discretion.

7. Promotions

7.1. The unauthorized use of myScoop usernames and myScoop-owned trademarks or products is not permitted except in the context of promoting a myScoop account (e.g., “Follow @accountname on myScoop" or “Add us on myScoop"). myScoop’s trademarks, including the myScoop app icon, must not be altered.

8. Reporting Violation

8.1. To report alleged copyright, trademark, or right of publicity infringement on myScoop, please send us an e-mail on [email protected]

9. Changes to Advertising Policy

9.1. myScoop is entitled to make changes to this Advertising Policy at any time. If myScoop makes any changes to the Advertising Policy, you will be informed hereof the next time you use the Platforms.

9.2. If you do not accept the newest Advertising Policy, you should not continue to use the Platforms. If you continue to use the Platforms, you automatically consent to the newest Advertising Policy.

10. Versions.

10.1. This is myScoop’s Advertising Policy of the 01 Jan 2022.
